Kelly Weaver is a partner and a member of the Healthcare and Medical Malpractice Practices. She focuses her practice in the area of medical malpractice defense, healthcare defense and insurance coverage litigation.
As a lawyer admitted to practice for nearly 20 years, Ms. Weaver has represented insurers, businesses and defended professionals in all phases of civil litigation at the trial and appellate level. Ms. Weaver has spent her entire career practicing in the areas of civil defense litigation and insurance coverage.
During law school, she achieved a class rank in the top 10% of her class, served as an editorial board member of law review and was selected from over 100 students for the school’s national moot court team. In 1992, she was inducted into the Order of the Barristers, the national honor society for law students who excel in oral advocacy competition, as well as the Order of the Curia for high academic achievement.
She has extensive civil litigation experience and has defended manufacturers, healthcare professionals, pharmacies, nursing homes, assisted living facilities, grocery stores, restaurants, retail stores, hotels, construction professionals and various other professionals and trades in cases involving personal injury/wrongful death, property damage, construction defects and contractual disputes.
As an attorney representing insurers in first party and third party cases for many years, she has extensive experience in insurance coverage and extra contractual/bad faith matters. She has represented insurance companies as well as their agents and insureds at both the trial and appellate level in the Florida state and federal courts. She has experience regarding insurance matters involving both first and third party coverage, including commercial general liability insurance, medical malpractice and professional liability insurance, automobile and trucking policies, garage policies, fire and casualty insurance, contractor’s and builder’s risk insurance, homeowner’s policies, officer and director liability coverage (DO), errors and omissions insurance (EO), excess/umbrella coverage, SIU /insurance fraud matters and has conducted numerous EUOs for insurance companies.
She was involved in the largest case in the history of the U.S. District Court for the Middle District of Florida and in that case, she conducted research, discovery and depositions throughout Canada on the part of the insurers of asbestos companies, disputing insurance coverage.
Ms. Weaver also is an experienced appellate lawyer and has prepared appellate briefs, extraordinary writs and has successfully presented oral arguments before the Florida District Courts of Appeal. In 1991, she served as an intern in the U.S. Court of Appeals for the 6th Circuit, where she assisted a federal judge in preparing appellate opinions.
